Regulators Unveil Appraisal Rules for Lenders

Starting in January 2014, mortgage lenders will work under new rules governing the handling of appraisals and other home value estimates. The Consumer Financial Protection Bureau (CFPB) announced Friday the adoption of a new rule intended to improve consumer access to appraisal reports. In addition, the CFPB (in partnership with five other federal regulatory agencies) issued a rule establishing specific appraisal requirements for higher-priced mortgage loans and properties flipped within six months of purchase.

CoesterVMS Implements Flat-Fee Model for Residential Appraisals

CoesterVMS announced that as of January 1, it has implemented the first flat fee model for residential appraisals. Through the new model, all conventional appraisals are priced at $450 while appraisals are $475. The Rockville, Maryland-based appraisal management company (AMC) explained a tiered fee structure is generally utilized, which determines prices based on the property type or location.

Case-Shiller Price Index Reaches 2-Year High in August

U.S. home prices continued to increase in August as the Case Shiller 20-city Home Price Index rose 0.9 percent to its highest level since September 2010. The index is up 2.0 percent in the last year, showing improvement in 19 of the 20 cities surveyed. The 10-city also rose 0.9 percent in August, increasing 1.3 percent ahead of August 2011 and reaching its highest level since October 2010. The monthly gain in each index was slower than in July, when the 10-city index went up 1.5 percent and the 20-city index improved 1.6 percent.

NAR: Distressed Sales Leading to Inaccurate Appraisals

In a September National Association of Realtors (NAR) survey related to home appraisals over the past three months, 11 percent of Realtors said a contract was cancelled because a home was appraised at a value below the negotiated price. Another 9 percent said a contract was delayed, and 15 percent said a contract was renegotiated to a lower sale price. One reason for the low values, according to the NAR, is because some appraisers are not taking into account the difference between distressed and non-distressed homes when making comparisons.

Sterling Savings Accused of Violating Labor Laws

Two mortgage loan officers are suing Sterling Savings Bank, based in Washington and with operations in Washington, Oregon, Idaho, Montana, and California, faces litigation for allegedly violating federal and state labor laws. According to the complaint filed in an Oregon federal court, Sterling Savings Bank and Golf Savings Bank denied mortgage loan officers and other mortgage origination employees overtime pay they are due under the federal Fair Labor Standards Act. Sterling Savings and Golf Savings merged in 2010.
